Delta-9 THC is the cannabinoid most people mean when they say THC. The version in a seltzer can is chemically the same molecule — the difference is the source and the accounting. Our Delta-9 drinks are made from hemp, which is what keeps them federally distinct from cannabis products.
The 0.3% rule, in plain terms
Under the 2018 Farm Bill, hemp is defined as cannabis containing no more than 0.3% Delta-9 THC by dry weight. Because a beverage is mostly water and therefore heavy, a can can hold a meaningful 5mg serving and still sit far under that threshold. That is the entire mechanism behind the category.

How the extract gets into the water
THC is not water soluble, so it has to be emulsified. NICE uses a nano-emulsion with gum acacia, which suspends microscopic droplets evenly through the liquid. Two things follow: the dose is consistent from the first sip to the last, and absorption is faster than an edible.
None of that is verifiable from a label alone, which is why every batch is third-party tested and the certificates of analysis are published.
